Welcome to Folo Foods (“we,” “us,” “our”), operated by NEXAR GLOBAL, UNIPESSOAL LDA.
These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile applications, and related services, including:
Folo Foods – Customer (ordering and delivery tracking)
Folo Foods – Store Manager (vendor/partner app)
Folo Foods – Delivery Partner (courier app)
By downloading, installing, or using our apps, you agree to these Terms. If you do not agree, please discontinue use immediately.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services.
Vendors and Delivery Partners may be required to provide identification or business verification documents.
You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
You agree to provide accurate and current information.
We may suspend or terminate accounts that are fraudulent, misleading, or violate these Terms.
Customer App:
Browse, order, and pay for meals from local vendors. Orders are subject to vendor acceptance and delivery feasibility.
Vendor App:
Allows vendors to manage and fulfill orders. Vendors are responsible for product accuracy, pricing, and compliance with laws (food safety, consumer protection, etc.).
Delivery Partner App:
Used by couriers to accept and complete deliveries safely and lawfully.
Folo Foods operates solely as an intermediary platform connecting customers, vendors, and delivery partners.
Payments may be made using MB WAY, Apple Pay, Credit/Debit Cards, Google Pay, or Samsung Pay.
All transactions are securely processed by authorized third-party providers (e.g., EasyPay).
Folo Foods does not store or have access to full card details.
Vendor and delivery-partner payouts follow the schedules and terms defined in the app or by contract.
You agree not to:
Use our services for unlawful purposes.
Interfere with or disrupt systems or networks.
Misuse payment or communication features.
Copy, reverse-engineer, or distribute the apps without written consent.
Location data is used to suggest vendors, calculate delivery fees, and track orders.
Delivery Partners consent to background location for live tracking.
You may disable location in device settings, but some functions may not work.
Promotions, coupon codes, and offers may change or expire without notice.
They cannot be exchanged for cash or transferred to others.
All content, trademarks, and software on the Folo Foods platform belong to NEXAR GLOBAL, UNIPESSOAL LDA or its licensors.
You are granted a limited, non-exclusive license to use the apps in accordance with these Terms.
Refunds and cancellations are subject to our Refund and Cancellation Policy, available on our website and app.
Due to the perishable nature of food, cancellations may not be possible once preparation begins.
Folo Foods acts as a marketplace platform and is not the seller of food.
We are not responsible for product quality, safety, or compliance provided by vendors.
To the maximum extent permitted by law, NEXAR GLOBAL, UNIPESSOAL LDA shall not be liable for indirect or consequential damages.
Personal data is handled in compliance with the EU General Data Protection Regulation (GDPR) and our Privacy Policy.
By using our services, you consent to the processing of your personal data as described in that policy.
We may suspend or terminate accounts for violations of these Terms or unlawful conduct.
These Terms are governed by the laws of Portugal and applicable EU regulations.
Disputes will be resolved in the competent courts of Portugal.
We may update these Terms periodically. Updates take effect upon publication, and major changes will be communicated via email or in-app notice.
